THE "TWO-FEATURE" RULE FOR CALIFORNIA HOMES
If you are selling a single-family home with a pool or spa deeper than 18 inches, the California Swimming Pool Safety Act (SB 442) is going to be your new best friend. Here is the big takeaway: when a home inspection is performed during a sale, the inspector is legally required to identify which safety features are present.
For many pools, especially those built or remodeled recently, you are required to have at least two of seven approved safety features. If your inspection report shows fewer than two, it often triggers a red flag for buyers, their agents, and even lenders.
While the law doesn't always force an immediate retrofit of an older pool just to list it, most buyers will demand these upgrades before they sign on the dotted line. Being proactive and having your two features ready to go means a smoother sale and a much stronger negotiating position!
1. PERMANENT ENCLOSURES AND FENCING
The most common and effective safety feature is a permanent enclosure. If you want to show buyers that your home is safe for a growing family, a sturdy, code-compliant fence is the gold standard.

To meet California standards, a pool fence must follow specific guidelines:
- Experienced height: The fence should be at least 60 inches (5 feet) tall.
- Reliable gaps: You can’t have any gaps at the bottom larger than 2 inches, and the vertical bars must be close enough that a 4-inch sphere can’t pass through.
- Clear access: Gates must swing away from the pool, be self-closing, and feature a self-latching device mounted at least 60 inches above the ground.
If your gate is dragging or the latch is sticky, that’s an easy fix we can handle during a regular equipment inspection. A gate that doesn't click shut is more than just a nuisance, it’s a liability waiting to happen during an appraisal.
2. REMOVABLE MESH FENCING
Not every homeowner wants a permanent iron fence cutting through their beautiful backyard view. If you’re staging your home to look its best, you might prefer removable mesh fencing.
This counts as one of your two required safety features, provided it has a self-closing, self-latching gate that can be locked. It offers 360-degree protection and can be taken down when the new owners are hosting an "adults-only" party.
When we perform our weekly pool service, we often check these fences to ensure they are tensioned correctly. A saggy mesh fence doesn't just look bad, it doesn't do its job!
3. EXIT ALARMS ON DOORS AND WINDOWS
Looking for the easiest way to hit that "two-feature" requirement? Door and window alarms are often the go-to solution for sellers.

If your home has a sliding glass door or a bedroom window that opens directly into the pool area, you can install exit alarms. These must be UL 2017 listed and produce an audible warning when the door is opened.
- Honest advice: While these are cheap and easy to install, they can be annoying for day-to-day life.
- Fair warning: Make sure the "bypass" button is high enough that a child can’t reach it!

4. ASTM-RATED SAFETY COVERS
If you have a spa or a smaller pool, a safety cover might be your best bet. To count toward your legal requirements, the cover must meet ASTM F1346 standards.
This isn't just a solar blanket to keep the heat in; it’s a heavy-duty cover designed to support the weight of an adult in case of an accidental fall. Automatic covers are a huge selling point for high-end homes, but even a manual tie-down safety cover for a spa can fulfill one of your safety feature requirements.
Keeping your pool covered also helps with maintaining water levels, which is another thing inspectors look for!
5. POOL AND SPA ALARMS
The fifth requirement you should know about is the pool water alarm. This is a device that sits in the water and sounds an alarm if it detects a surface wave or a change in pressure (like someone falling in).
While these are great as a backup, they shouldn't be your only line of defense. They are best used in conjunction with a fence or door alarms. When we are out for a filter cleaning, we often see these devices floating in a corner with dead batteries. If you're selling, make sure yours is chirping and ready for the inspector!
WHAT THE INSPECTOR IS LOOKING FOR
During the home sale process, the inspector isn't there to give you a fine, they are there to report the facts. They will check:
- Does the gate latch automatically?
- Are the door alarms loud enough?
- Are there at least two features present?
If the answer is "no" to any of those, it ends up in the report. Buyers then use that report to ask for credits or repairs. By handling these small safety items before you list, you keep the power in your hands.
